1. Introduction
Welcome to Buvaaz, a platform dedicated to empowering African creators and businesses by providing tools and resources for monetization, education, and community building. By accessing or using our services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not use our services.
2. Definitions
"Buvaaz": Refers to the platform operated by Buvaaz Commerce Ltd., including the website, mobile application, and all associated services.
"User" or "You": Any individual or entity accessing or using Buvaaz.
"Services": All features, functionalities, and content offered by Buvaaz.
"Creator": Any user who creates, uploads, or shares content on Buvaaz.
"Partner/Business": Any third party that collaborates with Buvaaz to offer products, services, or opportunities to users.
3. Eligibility
To use Buvaaz, you must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are under 18, you may only use Buvaaz under the supervision of a parent or legal guardian who agrees to these Terms.
4. User Accounts
Account Creation: You must apply through the Buvaaz mobile app or website. Approving a proposed account, and suspending or terminating approval of a current account, is at the Buvaaz's sole discretion. You must provide accurate, current, and complete information during the registration process and keep your account up-to-date. You are responsible for maintaining the confidentiality of your account, User ID and any related information.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to immediately notify Buvaaz of any unauthorized use of your account.
5. Use of Services
Permitted Use: You may use Buvaaz only for lawful purposes and in accordance with these Terms. You agree not to use Buvaaz in any way that violates any applicable local, national, or international law or regulation.
Prohibited Conduct: You agree not to: Engage in any activity that interferes with or disrupts the Buvaaz platform.Upload, post, or share any content that is unlawful, harmful, or offensive. Use Buvaaz to distribute unsolicited or unauthorized advertising or promotional materials.Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
6. Content Ownership and Rights
Your Content: As a creator, you retain ownership of any content you create, upload, or share on Buvaaz. By posting content on Buvaaz, you grant us a non-exclusive, royalty-free, worldwide, and sub-licensable license to use, reproduce, modify, adapt, publish, and display such content in connection with providing our services.
Buvaaz Content: All content provided by Buvaaz, including but not limited to text, graphics, logos, and software, is owned by Buvaaz or its licensors and is protected by copyright, trademark, and other applicable laws.
7. Partner/Business Collaborations
Buvaaz may collaborate with third-party partners and businesses to offer products, services, or opportunities to users. These partners/businesses may have their own terms and conditions, which will govern their relationship with you. Buvaaz is not responsible for any actions or omissions of these partners/businesses.
8. Payment and Fees
Subscription Fees: Certain features or services of Buvaaz may require payment of subscription fees. You agree to pay all applicable fees associated with your use of Buvaaz in accordance with the pricing and payment terms presented to you.
Refunds: All fees paid are non-refundable unless otherwise stated in these Terms or required by law.
9. Termination
Buvaaz reserves the right to suspend or terminate your account or access to our services at any time, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use Buvaaz will immediately cease, and any content you have shared may be removed.
10. Disclaimers and Limitation of Liability
Disclaimer of Warranties: Buvaaz is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or secure.
Limitation of Liability: To the fullest extent permitted by law, Buvaaz and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of Buvaaz.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Uganda. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the [Arbitration Institution], and you consent to the exclusive jurisdiction of such arbitration.
12. Changes to Terms
Buvaaz reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website or mobile application. Your continued use of Buvaaz after the posting of changes constitutes your acceptance of such changes.
